• Republic Act 8552 or Domestic Adoption Law provides the provisions
  • Local DSWD to provide free consultation and inquiries related to adoption, it’s processes and requirements
  • The law prohibits the discussion of adoption for unborn children
  • Direct adoption is considered illegal and carries a penalty of jail time

    • a pregnant or a new mom who is considering adoption, talk to a social worker (e.g. Grace to be Born in Pasig, Kaisang Buhay Foundation in Quezon, Haven for Women in Batangas or City Social Welfare in Dasmarinas, etc.)

Who can adopt? (for Filipino citizens and aliens)

  • Legal age
  • At least 16 years old then adoptee (e.g. baby is 2 years old, you must be at least 18 yrs old or older)
  • Has the capacity to exercise parental duties and authority
  • Has a good moral character; not convicted of any crime involving moral turpitude
  • Has the capacity to support, to educate and to care
  • Undergone pre-adoption services
  • For alien, must have a diplomatic relations with the Philippines, has been certified by their consular office that they are qualified for adopting a child, and their government allowed the process
  • For alien, has been living in the Philippines for at least 3 continuous years prior to filing of the application

Who can be adopted? 

  • Any person below 18 years old and has been declared available for adoption
  • A child whose previous adoption has been cancelled
  • A child whose biological parents has died

Adoption requirements in the Philippines

  • Birth and marriage certificates (authenticated)
  • Written consent from the children (legitimate and illegitimate) living with the applicant who are 10 years old and older
  • Health certificate, NBI or police clearance
  • ITR or proof of income
  • Character references
  • Latest family picture and home pictures
  • Home study report

    Ako po si Aiden Zabalo Domingo 31 years old and 9 years pong kasal Kay Jessie Garde Domingo nakatira dito sa Poblacion Taytay. Nais po naming magkaroon ng anak sakasamaangpalad Hindi parin po kmi nagkakaanak. Sabik po kaming mag asawa magkaroon ng anak.
